Transportation and Logistics The transportation and logistics experience gained from decades spent in the representation of carriers has allowed us to broaden the transportation and logistics practice into the representation of users of freight carriers - manufacturers, distributors, warehouses and other users. Representing industry in its use of motor carriers, brokers and logistics providers springs largely from the deregulation of economic controls over trucking and railroads and the colossal growth of the brokerage/3rd party logistics industry. Government regulation of shipper/transportation provider arrangements is gone. Those relationship are now a matter of contract - either a negotiated contract, a contract proposed by either participant, or a contract imposed by the carrier in its bill of lading. Vital issues including, among others, pricing, liability for loss of or damage to cargo, performance metrics, liability for delay, accessorial charges, indemnities and many other elements of the relationship are up to the participants. The growth of freight brokerage and 3PL's has distanced users from direct knowledge of their carriers and the services provided by them. While making advances in efficiency and cost savings, this has fostered the growth of an additional set of problems - loss of control over supply and distribution chains, the potential for double brokering and double payment, among others.
